MARSHALL COUNTY BULLIES PUPPY PURCHASE AGREEMENT

The buyer agrees to purchase the puppy                          from the litter by Marshall County Bullies, out of (dam)                   and (sire)                               born,                          for the amount of $           , plus shipping of $                .

Buyer agrees to read this contract carefully, print out this form, sign it, and send it back to  the seller, with their deposit of $300 made out to               .  The seller will sign the contract when it is returned and send a copy back to the buyer for their records.

The seller agrees to furnish the buyer with the necessary health information, including all shots and worming records.  The IOEBA and WBA registration application papers will be signed and executed at the time of sale.  You will receive temporary puppy papers for the organization which your puppy will be register able with.  The buyer understands that this puppy will be eligible for permanent registration.

PET HOMES:

All puppies purchased into "Pet Homes" will be required to be spayed or neutered before 6 months of age and proof MUST be provided to Marshall County Bullies before registration papers will be released to the buyer.  NO EXCEPTION!!!    In addition a spay/neuter contract will be sent to the buyer.  Said contract must be signed and returned to the seller before the puppy will be shipped.  Registries will be notified of the agreement.  Failure to abide by this agreement will result in buyer returning puppy at buyer's expense, and buyer will pay any legal fee's(small claims court) incurred by seller in retrieving the puppy.

BREEDING RIGHTS:

Marshall County Bullies has the right to screen all applicants wanting to purchase a puppy for breeding purposes.  Once screening is complete, and the buyer is approved, full breeding rights will be granted.  This agreement will be listed on this document and signed by both parties and registries will be notified.

DEPOSITS/PAYMENTS/SHIPPING:

Deposits are NON REFUNDABLE, except in the case of premature death, prior to delivery of the puppy to you.  In that instance any monies paid to the seller will be refunded to you, or you can transfer those monies to a future litter if you choose.  IF YOU CHANGE YOUR MIND AND DO NOT OR CAN NOT TAKE YOUR PUPPY YOU FORFEIT YOUR DEPOSIT.  The remainder of the payment must be paid in full prior to the puppy being shipped, or at time of pick up by you in cash only.  We will start taking deposits on pups at 3 weeks of age.  Pups are chosen in the order the deposits are received.  Seller ALWAYS has first choice in all litters.

Deposits are to be made in US Postal Money Orders, Paypal, or Cash in person only.  Once Marshall County Bullies has received your deposit the puppy will be marked and considered sold.

Choice of puppy is determined on a first come(deposit received) first to choose basis.  Puppy will be placed on hold for 4 days while we wait for your deposit to arrive at MCB.  If deposit is not received in that time frame, the puppy will be placed back up for sale.

ALL SHIPPING COSTS ARE THE BUYER'S RESPONSIBILITY.  $              THIS INCLUDES HEALTH CERT. FROM THE VET, AND FLIGHT CRATE.  ALL SHIPPING COSTS WILL BE PAID BY THE BUYER AT TIME OF DELIVERY AT THE AIRPORT.  THE BALANCE OF THE PUPPY IS DUE BY THE TIME THE PUPPY IS 6 WEEKS OF AGE UNLESS YOU ARE PICKING UP YOUR PUPPY.  IT SHOULD BE NOTED THAT AIRLINES WILL NOT SHIP BULLDOGGES IF THE FORECASTED TEMPREATURE IS NOT WITHIN THEIR GUIDELINES, this can cause obvious delays in the shipping of your puppy.  All puppies will be shipped at 8 weeks of age.  If unable to pick up or ship by then, additional kennel cost will be incurred unless prior arrangements have been made.  MCB will take care of all shipping arrangements for the buyer at buyer's cost.

Any pup not picked up or shipped after the 10th week of age will have additional boarding fees of $35 per week, unless prior arrangements have been made in writing with MCB.  The buyer will also be responsible for additional vaccinations, wormings, and any necessary vet care while the pup is still in our care.

ANY PUPPY THAT HAS HAD A DEPOSIT AND/OR PAYMENTS MADE ON THEM, THAT ARE STILL AT MCB WITH NO CONTACT FROM THE BUYER FOR 2 WEEKS AFTER THE 10TH WEEK OF AGE WILL BE CONSIDERED ABANDONED AND THE BUYER WILL FORFEIT ALL MONIES PAID TO THAT DATE, HAVE NO FURTER CLAIM TO THE PUPPY, AND IT WILL BE PLACED BACK UP FOR SALE.

YOUR MARSHALL COUNTY BULLIES PUPPY IS GUARANTEED AS FOLLOWS:

To be in good physical condition for the first 48 hours after the time of delivery to the buyer.  The buyer agrees to have the puppy examined by a LICENSED VETERINARIAN within 48 hours or the first business day if over a weekend or holiday for a complete physical examination.  If the vet finds the puppy to have a serious physical condition other than a bacterial infection, such as cocci dis, or giardia, which is easily treated, the seller will replace the puppy with another puppy of comparable quality, when available be it the same litter or a future litter, AFTER, the first puppy has been returned.  After the second opinion, again, after the first puppy has been returned.  After the second opinion the puppy will be replaced.  the seller always has the right to the refusal of a replacement puppy based on the situation findings.  IF THE PUPPY IS NOT EXAMINED BY A LICENSED VETERINARIAN WITHIN THE FIRST 48 HOURS OR THE FIRST DAY AFTER THE WEEKEND OR HOLIDAY AFTER THE DELIVERY TIME, THE GUARANTEE IS NO LONGER EFFECTIVE.

To be free of any genetic/hereditary defects that cause death or serious impairment of vital functions of the said puppy until 1 year of age.  If such an inheritable defect is documented by the vet and is presented to the seller with sufficient supporting evidence the buyer will be entitled to a replacement puppy of comparable quality, when available from an upcoming litter, AFTER, the first puppy is returned to the seller.  Puppy will have received vaccinations and wormings, depending on age of puppy at time of sale.  No replacements will be given in case of Parvo.  This guarantee does not cover what we consider to be normal problems of the bulldogge breed or problems beyond our control such as :  CHERRY EYE, ENTROPIAN, LOOSE HIPS, OR SKIN ALLERGIES SUCH AS LOCALIZED DEMODECTIC MANGE.  We can not guarantee that previous generations did not have any of these conditions.  This guarantee is void if the dog has been bred, altered, transferred, or euthanized without the seller's written consent.

GUARANTEE IS VOID IN CASES WHERE THE DOG IS IN ILLEGAL ACTIVITY(DOG FIGHTING), OR EXTREME SPORTS(WEIGHT PULLING), OR IS MISTREATED, MALNOURISHED, OR ABUSED.  VOID IF DOG IS BRED BEFORE 1 YEAR OF AGE.  GUARANTEE IS NON TRANSFERRABLE IF DOG IS SOLD BY BUYER.

BUYER AGREES TO THE FOLLOWING:

To use the initials of MCB of Marshall County Bullies as a prefix in the registration of the dog.

Maintain up to date vaccines, wormings, and keep the dog/pup in humane conditions providing love, proper food, water, and shelter for the dog/pup.  To no cropping of the ears and to no housing of the dog/pup outside.

If by chance you are unable to keep your pup/dog Marshall County Bullies has the right to reclaim the dog/pup or we will help you in finding the dog/pup a new home.  NO REFUND IMPLIED!!!!

THE BUYER AND SELLER AGREE THAT THIS IS THE FULL AND COMPLETE AGREEMENT THAT EXISTS BETWEEN THE PARTIES FOR THE SALE OF THIS PUP/DOG.  ANY AGREEMENTS MADE PRIOR TO THIS ARE CONSIDERED INCORPORATED INTO THIS CONTRACT AND ANY OTHER MODIFICATIONS MADE TO THIS AGREEMENT SHALL BE MADE IN WRITING OR SUCH SHALL NOT BE EFFECTIVE.  BY SIGNING THIS AGREEMENT YOU AGREE TO ALL OF THE ABOVE.  THIS AGREEMENT MUST BE SIGNED AND RETURNED TO THE SELLER.
